Welcome to Airstal (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Airstal, concerning your access to and use of the Airstal website, mobile application, and any other media form, media channel, mobile website, or affiliated platform (collectively, the “Site”).

We operate exclusively as an e-commerce retailer specializing in the marketing, sale, supply, and distribution of portable cooling devices, air circulators, and personal cooling technology—specifically, any and all types of fans manufactured and distributed worldwide. By accessing the Site, purchasing our products, or utilizing any of our services, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Site and must discontinue use immediately.

  • "Service" refers to the Site, online store, checkout portals, customer service channels, and digital experiences provided by Airstal.

  • "Goods" or "Products" refers specifically to the portable fans, personal cooling units, handheld fans, neck fans, clip-on fans, desk fans, wearable air management devices, and related accessories offered for sale on the Site.

  • "You" means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

2. ELIGIBILITY AND ACCOUNT REGISTRATION

By using this Site, you represent and warrant that you are at least the age of majority in your state or province of residence. To purchase certain Goods or access specific features, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are entirely responsible for safeguarding your password and restricting access to your electronic devices. You accept sole responsibility for any and all activities or actions that occur under your account.

3. SCOPE OF COMMERCIAL ACTIVITY

Airstal is a specialized commercial enterprise. The sole purpose, function, and objective of our business operations are the presentation, advertisement, and sale of personal and portable fans. We do not provide HVAC installation, residential electrical engineering services, structural cooling consultations, or large-scale industrial ventilation builds. Our inventory encompasses varying styles, power outputs, form factors, and aesthetic designs of portable fans. We reserve the right, but are not obligated, to limit the sales of our Products or Services to any person, geographic region, or jurisdiction.

4. PRICING, PAYMENT, AND BILLING ACCURACY

All prices for our portable fans are subject to change without notice. We reserve the right at any time to modify or discontinue any specific fan model, style, or colorway without prior notice.

  • Payment Methods: We accept major credit cards, debit cards, and approved digital payment processors.

  • Billing Info: You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address, credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed.

  • Taxes: Applicable sales tax, international tariffs, and regional duties will be calculated and appended to the final purchase price during the checkout sequence.

5. PROPRIETARY RIGHTS & INTELLECTUAL PROPERTY

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content:

  • For any unlawful purpose or to solicit others to perform or participate in any unlawful acts.

  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances.

  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others.

  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.

  • To submit false or misleading information or upload/transmit viruses or any other type of malicious code.

  • To scrape, crawl, spider, or systematically extract data from the Site to map out our global inventory of portable fans for competitive commercial distribution.

7. USER-GENERATED REVIEWS AND SUBMISSIONS

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, product reviews, or photographs of our fans in use, you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation to maintain any comments in confidence, pay compensation for any comments, or respond to any comments.

8. PRODUCT ACCURACY AND DISPLAY LIMITATIONS

We make every logical effort to display as accurately as possible the colors, features, and textures of our portable fans that appear on the storefront. However, we cannot guarantee that your computer monitor or mobile screen's display of any color or texture will be completely accurate. The technical specifications, battery capacities ($mAh$), runtime projections, and decibel sound levels ($dB$) provided on product pages are derived from manufacturer testing metrics and may vary slightly based on ambient room temperature, user handling, and environmental humidity.

9. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free. You expressly agree that your use of, or inability to use, the service is at your sole risk.

To the maximum extent permitted by applicable law, Airstal, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

You agree to indemnify, defend, and hold harmless Airstal and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

11. SEVERABILITY AND ENTIRE AGREEMENT

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions. The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

12. GOVERNING LAW AND JURISDICTION

These Terms of Service and any separate agreements whereby we provide you Services or Products shall be governed by and construed in accordance with the laws of the State of South Carolina, United States, without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of, or related to, these Terms shall be instituted exclusively in the federal courts of the United States or the courts of the State of South Carolina.
